Terms and Conditions

Pricing:

All prices on the website are in US Dollars.  Prices are listed by product and RMGS reserves the right to change pricing at Any time on Any product without notice. 

For all customers applicable taxes will be added to your order.  If you are ordering equipment for resale you will need to provide required exemption certificates prior to taxes being removed from the order. 

Shipping:

The shipping rates quoted on www.rockymountaingeneratorsupply.com are for the Continental U.S. (lower 48 states)-CONUS. If outside of this area there may be additional rates that apply. Additional shipping charges may include but are not limited to liftgate service, ferry charges, rural locations, etc. The freight service may or may not be able to deliver on a dirt road so if this is the case please notify our shipping department prior to shipment arriving to make arrangements. Your product may be delivered with a trailer, semi-truck, box-truck, etc. and delivery is made as a curbside service. Curbside Service means the freight company will deliver to your address and lower your generator to the ground.  The freight company will not back down driveway’s, place a generator in a building or where it is being installed.  You are responsible for arranging the movement and setting of the generator.  Before signing the delivery receipt or bill of lading you must inspect product for damages. If item is damaged, do not accept shipment otherwise returns and exchanges may not be accepted.

DO NOT ACCEPT ANY DAMAGED GOODS!

Open and inspect your delivery Before you sign for it!  Once you sign for it, the responsibility to make and manage a damage claim with the carrier that delivered your product(s) is now your sole responsibility.  RMGS makes every effort to ensure that all shipments are damage free upon shipment. 

Refused shipments; Customers shall be charged all shipping charges, and a 20% restocking fee for all refused shipments, including shipments refused due to damage and then cancelled.  This covers the cost to receive and inspect all returned items.

Risk of Loss:

All purchases of physical items from Rocky Mountain Generator Supply are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier. 

Returns and Cancellations:

If you are not satisfied with your purchase, you may return it for a refund within 30 business days of date of purchase.

To initiate a return, send an e-mail to sales@rmgsco.com or call  (303) 777-6778. You will be required to provide your invoice number and order information.  It is the responsibility of the customer to ensure that the merchandise is shipped back to us in the original packaging, in new, unused condition and include all the parts, instructions, and accessories.  Packages that have been opened may be subject to additional fees.  Upon receipt of the returned merchandise, RMGS will verify the condition of the return and issue a refund in the form of the original payment. The refund will be for the original purchase amount less original shipping charges and any return shipping charges not paid for by the customer.

RMGS reserves the right to deny a full refund of the purchase price if the product is not returned in this manner and condition. Also, we reserve the right to charge a restocking fee of 20% on any returned or canceled orders. 

Order mistakes made by RMGS; call RMGS immediately (303) 777-6778 with a description of the issue and we will make arrangement for pick-up and then ship a replacement of the correct item.

Cancellations; RMGS will honor cancellations only if the order has not been shipped.  To cancel, you must notify us no later than the next business day after placing your order.  A $25.00 processing fee will be billed against your credit care for orders up to: $1,000.00, and $50.00 charge for order up to $10,000.00, and charges for orders over $10,000.00 will be determined at time of cancellation.  If you cancel your order and it has already been shipped; you will be responsible for any shipping fees and could be subject to a 20% restocking fee. 

Product Descriptions:

Rocky Mountain Generator Supply attempts to be as accurate as possible. However, Rocky Mountain Generator Supply does not warrant that product descriptions or other content of any Rocky Mountain Generator Supply Service is accurate, complete, reliable, current, or error-free. If a product offered by Rocky Mountain Generator Supply itself is not as described, your sole remedy is to return it in unused condition.

Your RMGS Account:

You may need your own Rocky Mountain Generator Supply account to use certain Rocky Mountain Generator Supply Services, and you may be required to be logged in to the account and have a valid payment method associated with it. If there is a problem charging your selected payment method, we may charge any other valid payment method associated with your account. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account, and you agree to accept responsibility for all activities that occur under your account or password. Rocky Mountain Generator Supply does not sell products for children, but it sells them to adults, who can purchase with a credit card or other permitted payment method. If you are under 18, you may use the Rocky Mountain Generator Supply only with involvement of a parent or guardian. Parents and guardians may create profiles for teenagers in their Rocky Mountain Generator Supply household. Rocky Mountain Generator Supply reserves the right to refuse service, terminate accounts, terminate your rights to use Rocky Mountain Generator Supply, remove or edit content, or cancel orders in its sole discretion.

Persons who supply us with their telephone numbers on-line will only receive telephone contact from us with information regarding orders they have placed on-line.

With respect to Ad Servers: We do not partner with or have special relationships with any ad server companies.

From time to time, we may use customer information for new, unanticipated uses not previously disclosed in our privacy notice. If our information practices change at some time in the future, we will use for these new purposes only data collected from the time of the policy change forward.

With respect to security: We always use industry-standard encryption technologies when transferring and receiving consumer data exchanged with our site. When we transfer and receive certain types of sensitive information such as financial information, we redirect visitors to a secure server. We have appropriate security measures in place in our physical facilities to protect against the loss, misuse or alteration of information that we have collected from you at our site. We use the Red Hat Linux OS and Apache Server secured with Apache-SSL to protect your billing information. Secure Sockets Layer (SSL) encrypts information and keeps the data private and confidential between your machine and Rocky Mountain Generator Supply.
